What financial conditions should be observed when transitng goods through territory of EAEU

One of the main conditions of the customs transit is the presentation of the security of payment of customs duties. It was said in the article of Chairman of the Board of the Eurasian Economic Commission Tigran Sargsyan.

In the opinion of the Head of the Board of the EEC, such security may be presented in the form of cash, bank guarantee, suretyship or property pledge.

"At the same time, security will not be required if a customs carrier or an authorized economic operator acts as a declarant. Also, it is not necessary to guarantee the payment of customs duties and taxes if the goods are transported by rail, air or pipeline transport", Tigran Sargsyan said in his article.

Representation of security will not be required if its amount in respect of imported goods does not exceed 500 euros.

Sargsyan also talked about practical actions that the Commission plans to take to create conditions for non-submission of permits to customs authorities.

"The EAEU Costoms Code allows not present to the customs body documents or information necessary to fulfill customs operations, if they can be obtained from information systems in the framework of information interaction. To implement such a progressive step, the Commission plans to adopt a number of decisions aimed at organizing information interaction between the customs authorities of some EAEU Member States with authorities authorized to issue permits by other bodies", the article reads.

At the same time, when fulfilling customs operations by a customs representative on behalf of the declarant, the customs representative bears a joint duty with such a declarant to pay customs duties.

At the same time, in cases where the customs representative cannot and should not influence compliance with certain conditions, non-fulfillment of which entails the payment of customs payments, the customs body will not have the right to collect customs payments from the customs representative.

"These are cases of non-compliance by the declarant with the conditions for the use of goods in accordance with the customs procedure under which goods are placed, changes in the timing of payment of customs duties and taxes, as well as violations of the purposes and conditions for granting privileges for payment of customs duties, taxes or restrictions on the use and disposal of goods", Sargsyan said.
